Terms of Use

These Terms of Use ("Terms") govern your access to and use of the StrumLab Music application, website, and related services (collectively, the "Service"), operated by StrumLab ("we", "us", or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Eligibility
You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use the Service.
By using the Service, you confirm that you have the legal capacity to enter into these Terms.
Accounts
To access certain features, you must create an account.
You agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Notify us immediately of any unauthorised use
You are responsible for all activity that occurs under your account.
Subscriptions & Payments
Subscription Access
Some features of the Service require a paid subscription.
Subscriptions may be offered on a monthly or annual basis and grant access to the Service for the duration of the subscription period.
Billing
For subscriptions purchased outside of Apple's App Store:
- Payments are processed via our payment provider
- Subscriptions renew automatically unless cancelled
- You may cancel at any time via your account settings
For subscriptions purchased via Apple In-App Purchases, Apple's terms apply and billing is handled by Apple.
Refunds
Except where required by law, payments are non-refundable.
Nothing in these Terms affects your statutory consumer rights.
Digital Content & Right to Cancel
Where you purchase digital content or a subscription outside of Apple’s App Store, you acknowledge that access to the Service may begin immediately.
By starting a subscription, you consent to immediate access to the Service and acknowledge that you may lose your statutory right to cancel once the Service has been fully provided, in accordance with UK consumer law.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with or disrupt the Service
- Upload or share content you do not have the right to use
We reserve the right to suspend or terminate accounts that violate these Terms.
User Content
You retain ownership of any content you upload or create using the Service ("User Content").
By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, process, and display User Content solely for the purpose of operating the Service.
You are responsible for your User Content and confirm that it does not infringe the rights of others.
Generated Content
The Service enables users to create music and other audio content using a combination of artificial intelligence systems, algorithmic processes, and proprietary musical libraries, including libraries of chords, patterns, and musical structures developed by us ("Generated Content").
Subject to your compliance with these Terms, you retain all rights, if any, you may have in the Generated Content you create using the Service.
We retain all intellectual property rights in the underlying software, algorithms, models, and proprietary musical libraries used to generate the Generated Content.
We do not claim ownership of the Generated Content itself.
You acknowledge that Generated Content may be similar or identical to content generated for other users, or to existing musical works, due to the nature of algorithmic and AI-based generation.
Exported Content (Including MIDI)
The Service may allow you to export Generated Content, including in MIDI or other file formats.
Once exported, you are solely responsible for how the exported content is used, distributed, modified, or incorporated into other works.
We do not guarantee that exported content will be free from third-party rights or claims, and you are responsible for ensuring that your use of exported content complies with applicable laws and does not infringe the rights of others.
Intellectual Property
All intellectual property rights in the Service, including software, design, branding, and content (excluding User Content), belong to StrumLab.
You may not copy, modify, or distribute any part of the Service without our prior written consent.
Nothing in these Terms grants you any rights in our underlying musical libraries, algorithms, or generation systems, except as necessary to use the Service in accordance with these Terms.
Availability & Changes
We aim to provide a reliable Service but do not guarantee uninterrupted availability.
We may:
- Modify or discontinue features
- Update the Service
- Update these Terms from time to time
Where changes are material, we will take reasonable steps to notify users.
Termination
You may stop using the Service at any time.
We may suspend or terminate your access if:
- You breach these Terms
- Required by law
- The Service is discontinued
Upon termination, your right to use the Service will cease.
Disclaimer
The Service is provided "as is" and "as available".
To the fullest extent permitted by applicable law, we exclude all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no representations or warranties regarding the originality, copyright status, or suitability of Generated Content or exported content for any particular purpose.
Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
Nothing in these Terms limits liability that cannot be excluded under applicable law.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Governing Law
These Terms are governed by and construed in accordance with the laws of Scotland.
The courts of Scotland shall have exclusive jurisdiction to settle any disputes arising out of or in connection with these Terms, except that consumers may bring claims in the courts of their country of residence where required by law.
iOS Users (Important)
If you downloaded the app via Apple's App Store and subscribed using Apple In-App Purchases, your use of the app is additionally governed by Apple's Standard End User License Agreement (EULA). In the event of a conflict, Apple's EULA shall prevail.
